Complaints processing: Regulatory changes
|
|
|
The Regulation respecting complaint processing and dispute resolution in the financial sector will come into force on July 1, 2025. This regulation is intended to ensure the fair processing of complaints for all Québec financial consumers and to foster a culture of continuous improvement within the financial sector.
Among other things, the regulation sets out the elements that must be included in:
- your complaint processing policy
- the summary of the policy to be given to your clients.

Statement pertaining to insolvency
|
|
|
Since March 22, 2025, representatives certified under the Distribution Act have been required to notify the AMF if they file a consumer proposal or a proposal. The statement forms have been updated to reflect this change.
We remind you that the AMF must be informed within five days after a proposal is filed or a bankruptcy is declared.

Changes to the career entry rules of future representatives
|
|
|
A number of amendments to the Regulation respecting the issuance and renewal of representatives’ certificates (the "Regulation") received ministerial approval in February 2025. One of the purposes of these amendments is to make the career entry rules for future representatives more flexible.
Effective March 26, 2025, representatives that have been authorized to act in a Canadian province or territory other than Québec for at least 24 of the past 36 months may, under certain conditions, be exempted from the probationary period.
The damage insurance sector and claims adjustment sector systems of reference for career entry were also updated on March 26, 2025, to reflect the new requirements that are in effect. The minimum amount of time you need to have worked to obtain an attestation of full-time employment is now 30 months.
Effective September 15, 2025, the following rules for rewriting exams will apply: a candidate who fails an examination will be entitled to write three supplemental examinations. Distinctions as to the minimum qualifications required and the duration of the exam validity period are drawn based on the specific requirements for each sector.
Effective September 14, 2026, the new Regulation will bring greater flexibility to the probationary period, particularly in terms of length, number of hours to be completed per week and maximum number of trainees that may be supervised by a representative who engages primarily in the supervision of trainees.
